Welcome to NextGen Living! These Terms and Conditions govern your use of our application and services. By accessing or using our app, you agree to be bound by these terms.

2. User Account

To access certain features of the app, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and are liable for all activities under your account.

3. Use of the App

You agree to use NextGen Living only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the app. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our app.

4. Intellectual Property Rights

The content, layout, design, data, databases, and graphics on this app are protected by intellectual property laws. Unless expressly permitted in writing, you should not reproduce, modify, copy, distribute, or use for commercial purposes any content without the written permission of NextGen Living.

5. Privacy Policy

Your use of our app is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the app and informs users of our data collection practices.

6. Changes to Terms

NextGen Living reserves the right to change these terms from time to time and your continued use of the app will signify your acceptance of any adjustment to these terms.

7. Limitation of Liability

NextGen Living will not be liable for any indirect, special, incidental, punitive, or consequential damages or any loss of profits, revenue, data, or data use. Our maximum liability for any damages arising out of or related to the app or your use of the app will not exceed the amount you paid us to use the app.

By submitting payment, deposit, or authorizing services with NextGen Living (“Company,” “we,” “us,” or “our”), the client (“you”) expressly acknowledges, understands, and agrees to the following Terms & Conditions.

1. Scope of Services

Services are performed based on the service type selected and the information provided by the client at the time of booking. Any services not explicitly included in the original scope are considered additional and may require extra time and fees.

2. Pricing & Condition Disclosure

All pricing is based on average home condition and the client’s description provided during the initial inquiry.
If actual conditions differ materially from what was disclosed—including but not limited to heavy buildup, excessive clutter, pet hair accumulation, unsanitary conditions, or restricted access—NextGen Living reserves the right to:
  • Adjust pricing
  • Limit the scope of work
  • Extend service time
  • Decline service without refund if conditions prevent safe or reasonable completion
Client acknowledgment is required before proceeding with any price adjustment.

3. Deposits, Authorization & Payment

A deposit is required to reserve service time and remove the appointment from availability.
The deposit represents a good-faith reservation of labor, scheduling, and travel resources.
Deposits are applied toward the total service cost when service is completed as scheduled.
  • By submitting payment, the client authorizes NextGen Living to charge the provided payment method in accordance with these Terms.
  • Credit card payments may include a processing fee.
  • Certain payment methods may require full payment upfront.

Failure to submit payment does not constitute a confirmed booking.

4. Cancellation, Refunds & Arrival Fees

Cancellations made 48 hours or more before the scheduled service time qualify for a full deposit refund.
  • Cancellations made within 48 hours of the scheduled service time forfeit the deposit, which is retained as compensation for reserved labor and scheduling costs.
Same-day cancellations, no-shows, or services declined upon arrival are subject to a non-refundable arrival fee equal to the deposit paid.
  • Deposits are not refundable once the service window falls within 48 hours of the scheduled start time.
This policy reflects actual business costs and is not a penalty.

5. Access, Readiness & Safety

Clients are responsible for ensuring the property is accessible at the scheduled time, including providing entry instructions and securing pets.
NextGen Living reserves the right to refuse or discontinue service if conditions are unsafe, unsanitary, or materially different from what was disclosed. In such cases, the deposit or arrival fee may be retained.

6. Breakage, Damage & Claims

While reasonable care is taken, any claims of damage must be reported within 24 hours of service completion.
Liability is limited to repair or replacement cost of the damaged item and shall not exceed its current value.
We are not responsible for:
  • Pre-existing damage
  • Improperly installed items
  • Fragile, unsecured, or high-value items not disclosed prior to service

7. Satisfaction & Disputes

Service concerns must be reported within 24 hours of completion. The Company may, at its discretion, offer a re-clean of affected areas.
Refunds are not guaranteed and are not issued for dissatisfaction related to time estimates, condition assumptions, or scope misunderstandings disclosed in these Terms.

8. Chargebacks & Payment Disputes

By submitting payment, the client agrees to contact NextGen Living directly to resolve any billing concerns prior to initiating a chargeback.
Unauthorized chargebacks that violate these Terms may be disputed using service records, communications, payment authorization, and acknowledgment of these Terms.

9. Limitation of Liability

NextGen Living shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the service in question.

10. Privacy & Data Use

Client information is collected solely for service fulfillment, communication, and payment processing. Payment information is processed securely by third-party providers. We do not store full credit card details.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of California.

12. Acceptance & Electronic Agreement

Submission of a deposit, payment, or authorization constitutes electronic acceptance of these Terms & Conditions and serves as a binding agreement between the client and NextGen Living.
